SUPERVISORS REPORT

As the newly appointed Supervisor of Local 5, I am looking forward to working with all of the Local 5's Officers and Business Agents as well as the entire membership. The regular monthly meeting will be held on April 3rd and a special nomination meeting will be held on Monday April 17th. I, along with former Supervisor Joe Romano, will hold classes on election procedures for all candidates and election judges on Monday, April 24th.
     When voting you will need to bring a picture I.D. and your union card.

COALITION OF LABOR UNION WOMEN
On March 5th a group of Local S women, along with Joe Romano, attended a dinner sponsored by the Coalition of Labor Union Women (C.L.U.W) Their honorary guest speaker was the AFL-CIO Regional Director Mary Crayton. She gave a very interesting speech. It wasn't about just women or laborers, but about all workers bettering their lives through unions.
      After the dinner we introduced ourselves and our local to the group. We were then invited to attend the Working Women Conference 2000 at the Hyatt Regency. It was a very nice evening.
     I encourage everyone to participate in all union events. It can only better ourselves and our local union to become involved.

SOUTHSIDE SAFETY COMMITTEE

On March 10, 1999 Local #5 representatives went to it's typi-
cal Southside Safety Committee meeting. There were approximately 18 business Agents from all of the trades represented there.
       One of the stops was in Palos on a good job gone bad  by the developer. All of the agents converged on the site at the same time. The developer became nervous and called the
 police. We were all asked to leave because it was private property) and we did.
    This action didn't turn the job

around but it is the first of many actions that will be taken against this developer.

 OUT OF WORK LIST INFORMATION


    
Local 5 has been experiencing some problems with Rule #2 on the Out of Work List.
    Rule #2 reads: A laborer must register in person within 90 days (3 months) from his or her last registration date or you will be removed from the list.
    These rules are passed down to all of the local unions in every state of the country .
    Here at the Local 5 we are going to make some changes to help the members remember RULE #2.
     1. Next to your name on the out of work list will be your re-registration date.

    2. We're giving out the rules with your re-registration date and signature of on the out of work list.
    There are two reasons for doing this. One is so that the union knows that the member has received his re-registration date and the other is for the member to take home rules with his re-registration date posted on it for future reference.
    Feel free to call your Local Union at any time and ask when your re- registration date is.

 

We've been experiencing problems with receiving mail in the past so we've decided to purchase a post office box to insure our receiving mail properly in the future.

The Chicagoland District Council
Laborers Union held it's first con-
tested election in decades on
March
1, 2000.

The New Officers Are:

Many of these officers were laborers working in the field. They worked their way up through the Laborer's Union as stewards, officers, B.A.'s and B.M.'s in their own locals. They can relate to the life of a laborer.

MEMBERSHIP
MEETING INCENTIVE

PROGRAM  

1 .Any Brother or Sister who attends eight (8) general membership meetings in one ( 1) calendar year will receive a Local #5 sweatshirt with logo.

2. Any Brother or Sister who attends twelve ( 12) general membership meet- in~ in a row will receive a Carhart jacket or similar with Local #5 logo.

3. Any brother or Sister who finishes paying dues for the year 2000 by the end of April, 2000, will receive a Local #5 jacket or similar with logo.

4. Rules to receive the Carhart jacket:

When you next attend a meeting: Print members in good standing that can re- your name on the sign in sheet You will receive watches. Anybody who thinks then receive a card with your name on it. they have been in Locallf5 for twenty- It is your responsibility to keep this five (25) years or more can call the card and get it stamped and dated at  every meeting you attend. twelve (12) meetings in a row are stamped and dated on your card, present your card to Local #5 office. You will then receive a voucher to receive your Carhart jacket at the store WORK-EN-GF.AR in Matteson. Your stamped card and membership sign-in sheet must corellate with each other.

When paying your dues for the whole year ask for and you will re ceive a voucher for the carhart jacket.

 

 5. 25 Year Service Watch: We are going to send out self-addressed en velopes asking how many members can attend the meeting for the presentation of watches for members of 25 years of service or more. We went through our records and they indicated that there are approximately 143 paying members in good standing that can receive watches. Anybody who thinks they have been in Local #5 for twenty five or more can call the local # 5 office and we will check further. 

JUST FOR YOUR INFORMATION

*Your quarterly dues are $72.00 a quarter due in the office by the last day of the second month in the quarter due. Please allow time for mailed in payments. Payments are due as follows: 1/4- last day of February; 2/4 -last day of May; 3/4- last day of August; and 4/4- the last day of November.
The G.E.B. is enforcing payment of dues irregularities by locals. The G.E.B. is doing this because members.
by paying their dues dictate who may be suspended or readmitted each quarter. Local 5 pays the
International Laborers Union in Washington D. C. a per capita tax each month to avoid irregularities or late payment by the local to the International. The above dates for paying have to be followed.

Q: How do I determine how many pension credits I have?

A: Your pension credits are co ordinated between our fiscal year from June 1st thru May 31 st. Then, how many pension hours have been paid
into the pension fund department deter- mines the amount of pension credits you'll receive in that fiscal year. Before 1998 it took I ,000 for one (1) pension credit. Then in 1998 and 1999 we had an upgrade in pension credits per hour. They are as follows:
       under 250 hrs. = 0 credits
       250 -499 hrs. = 1/4 credit
       500 -749 hrs. = 1/2 credit
       750 -999 hrs. = 3/4 credit
   I ,000 -1 ,499 hrs. = I credit
   1 ,500 -I ,899 hrs. = I 1/4 credits
   1, 900 & up hours = 1 1/2 credits per pension credit is $79.50

  APPRENTICE PROGRAM *

     The apprentice program will be taking off this year starting with 75 apprentices in the spring of
                                  2000.

Local #5's two (2) apprentices are:

    Vince Canzone worked for Tichacek Masonry and Concrete by Wagner .

    Sandra Kalinowski worked for the Hullet Corp and Powers Construction .

     Both apprentices are approaching their second year.

NEWS FROM OUR TRAINING. CENTER

The Training Center received a letter from the Secretary of State Drivers Service Dept. of Illinois dealing with the CDL road testing class.
     The letter stated changes have been made regarding the procedures now necessary for this program.

 ( 1) A 2 week training program is now required for ~ CDL applicants.
     (2) Notification by a third party of any changes in the work status of any person with a CDL license that was received through our program.

   These changes will severly impact the Training Fund's ability to offer this course.
     A meeting has been scheduled during April 2000 with the Secretary of State that will determine if it will be possible for the Training Center to offer these classes.
    In the meantime the Training Center is not accepting applications for the CDL written or the road test courses.

On February 25. Local 5 closed on the purchase of the building located at 134 North Halsted, Chicago Heights.
    A new sign was made and erected facing Halsted Street.
    We are taking bids on a roof replacement and new heating and air conditioning systems.
   All of the necessary insurance is in place. We started work. on the new building March 13. 2000 with members from the out-of-work. list. The list will be alternated weekly.
Also we will be working with an architect in de- signing the office and membership meeting hall. Once we have the blue prints we will start our build out.

These increases didn't come from generous contractors in the last couple of decades. They came from the hard work of union organizers, representatives and negotiators. They worked for  each increase at the end of every contract but the heart of the increases came from each end every member out there that believes in his/her union.

 

ARTICLE V
Qualifications for Office

In order to qualify as a candidate for any office in a Local Union. a member:
  Section 1. Shall be required to have been in good standing in the International Union for a period of two years and in good standing in the Local Union for a period of two  years immediately prior to nomination and to be current in the payment of his dues: these requirements shall not apply in cases \\hen Local Unions have been chartered for a period of less than two years prior to the date of nomination.

   Section 2. Shall be a citizen of the United States or Canada. unless such requirement is prohibited by provisions of applicable law.

  Section 3. Shall be literate.

  Section 4. No person shall be eligible to hold any office in the Local Union if he has not been regularly working at the calling of the International Union during the entire year immediately prior to nomination. "Working at the calling" shall be defined to include:
  (a) Employment for which the Union serves, or is actively seeking to serve, as the exclusive collective bargaining representative of employees:
   (b) Employment in a full-time official capacity for the Local Union:
   (c) Employment by government or the trade union movement in a capacity directly related to the calling and one which would directly benefit the Local Union and its members except that employment by the Local Union in a clerical or administrative position shall not be deemed to be working at the calling'.:
  d) Periods of unemployment where the member was available for and continuously and actively sought employment at the calling which shall be understood to require full compliance with the lawful rules of the referral service or hiring hall. if any. operated by the Local Union:
   ( e) Members who can prove they were unable to work because of temporary illness or disability of less than one year so long as

 

that member has a reasonable expectation of returning to work in the foreseeable future.
  In examining the circumstances of each particular case. due regard shall be given to the good faith involved.
  Section 5. No person \\ho has been debarred after trial. from holding office, shall be qualified as a candidate during the period of his debarment.
  Section 6. A candidate shall not be eligible to run for office if he is a member of. or a sympathizer with, any organization that has for its purpose the overthrow of this Organization or of the Government of the United States of America or of Canada. by force or violence, or who is unable to qualify under this constitution and in accordance with the provisions of existing law.
   Section 7. A candidate must agree to observe, conform and comply with all of the terms and provisions of the International Union Constitution. the Uniform Local Union Constitution and the Uniform District Council Constitution and all of the rules, regulations, policies. practices and lawful orders and decisions adopted and promulgated in the furtherance and administration of the pro- visions of the said Constitutions.
   Section 8. Such candidate must agree to refrain from conduct that would interfere with the proper conduct of all of the business of the Organization.
   Section 9. Such candidate must agree to recognize his responsibility toward the preservation of the Union as an institution.
   Section 10. All of the qualifications for office must be present at the time of nomination. as well as at the time of election and during the term of office.
   Any person who receives a pension from a pension or a retirement fund related to the International Union or any affiliate thereof shall be presumed to be a retiree and. therefore. not to be working at the calling of the International Union and not to be qualified as a candidate for office. The burden shall be on such pension recipient to demonstrate affirmatively to the satisfaction of the Judges of Election that such individual nonetheless meets the constitutional qualifications for office.

       ARTICLE VI

            Nomination and Election of Officers

  Section I. NOMINATIONS:

  (a) A special meeting, to be known as the "Nomination Meeting shall be held not less than ten days nor more than twenty days prior to a regular meeting of the Local Union to be held in the month of May of the election year, at which nominations shall be made for all of the offices or positions to be filled;

  (b) No less than seven days prior to said Nomination Meeting. notice thereof shall be mailed to each good-standing member of the Local Union at his last-known address. and such notice shall list the offices and positions to be filled and the time and place of such meeting;

  (c) Three Judges of Election shall be appointed prior to the Nomination Meeting by the Executive Board of the Local Union. They shall not be candidates for office but they shall possess all the qualifications required of candidates for office except that they may be retired;

  (d) The salary and compensation to be paid to elected officers or officials shall be fixed prior to the nominations: provided that adjustments to salary during the term of office may be effected in accordance with the provisions of Article IX herein:
  (e) A member in good standing shall be eligible to be
 nominated for office in the Local Union. Such member shall meet all of the requirements of qualification hereinabove outlined;

(f) All members nominated shall be nominated by another member in good standing and shall be present at the time of nomination,

, unless absent from the meeting on business for the Local Union, for the District Council, or for the International Union, or excused for just cause by a vote of the membership of the Local Union and shall indicate immediately upon nomination whether it is accepted or declined. Once a nomination is accepted, the nominee has no right to withdraw his candidacy prior to the election;

  (g) Nominations shall be made in the following order: President, Vice President, Recording Secretary, Secretary- Treasurer, Business Manager-Delegate, Sergeant-at-Arms, Auditors (3), Executive Board Members.

  This order is subject to combination of offices, when approved, in accordance with constitutional provisions. No member may be a candidate for, nor hold more than one office, except where a combination of offices has been approved, in accordance with the provisions of this Constitution;

  (h) All elected officers shall serve for a term of three years, provided, however, that the term shall be four years where the law permits. The newly elected officers shall take the oath of office and be installed by the presiding officer at the first regular meeting after the election.
