ORDER AND MEMORANDUM

This Order and Memorandum addresses the election protest of Gene Julian (“Julian”) regarding the qualification of Paul Tigno (“Tigno”) to hold office in the Laborers’ International Union of North America (“LIUNA”) Local Union 230 in Hartford, Connecticut.

Tigno was nominated for Executive Board Member on May 17, 1999.  Tigno was the only candidate nominated and was declared the winner.  See Article VI, Section 2 (e) Uniform Local Union Constitution (“Constitution”).  Because there was no election the Independent Hearing Officer (“IHO”) will treat May 17, 1999 as the date of election.

Julian filed his protest with the IHO on June 21, 1999.  Article XII, Section 8 of the Constitution provides that election protests must be filed with within thirty days of the election.  The IHO may waive the application of this provision upon good cause shown.  In the instant case there is no good case shown for such a waiver and the protest of Julian is therefore DENIED.
