4   Q   Now,   the 50/50.   Take a look at

5   it.   What does the 50/50 mean,   in your mind?

6   A   50/50 is 50 percent company,   50

7   percent union,   but with the requests,   it is

8   called 50/50,   but it is really not   50/50.

9   Q   Tell me what you mean by that.

10   A   You can request anybody you want

11   from the company and put them on the list and

12   request them.

13   Q   So let me tell you my questions   

14   having to do with the 50/50 on this jobsite.

15   I've done some homework on this.   But I want

16   you to feel free to refer to your shop

17   steward reports.   You can challenge my work

18   here, but I would like to hear what your

19   challenge is.   All right?

20   If you take your first report,

21   mean,   there is no -- shop steward reports

22   evolved over the time period to show yes

23   dispatch no dispatch; union or company.   At

24   this time period,   the 50/50 was still a

25   requirement; correct?

2   A   Correct.

3   Q   Now,   if you can explain to me why

4   I'm wrong,   you tell me.   Rick Flanell,   was

5   certainly a company man.   He was the foreman;

6   correct?

7   A   Yes.

8   Q   You are a union man, you were

9   dispatched there,   although we've talked about

10   it;   correct?

11   A   Yes.

12   Q   Joe D'Agostino,   why isn't he a

13   company man?

14   A   He was requested off the list.

15   Q   Let me tell you why I take issue

16   with that.   When Joe D'Agostino was not

17   requested until September 27 -- I've gone

18   through these records.

19   A   Okay.

20   Q   So when he, and this is an issue

21   that is more the District Council's than your

22   issue.   But I'm still asking you to try to

23   explain here,   because I don't find the 50/50,

24   at least at this stage,   to be in effect.

25   find,   and I'll tell you why, you can debate
