TITLE: SENATE RESOLUTION 292 -- AUTHORIZING THE PRODUCTION OF DOCUMENTS BY THE PERMANENT SUBCOMMITTEE ON INVESTIGATIONS

TEXT:  Mr. BYRD (for himself and Mr. Dole) submitted the following resolution; which was considered and agreed to:

S. RES. 292

Whereas, in 1981 the Permanent Subcommittee on Investigations of the Committee on Governmental Affairs investigated and held hearings on the influence of organized crime on the International Longshoremen's Association;

Whereas, the Department of Justice has requested access to certain materials in the Subcommittee's files from that investigation for use in a current criminal investigation;

Whereas, by the privileges of the Senate of the United States and Rule XI of the Standing Rules of the Senate, no evidence under the control or in the possession of the Senate can, by administrative or judicial process, be taken from such control or possession but by permission of the Senate;

Whereas, when it appears that documents, papers, and records under the control or in the possession of the Senate are needful for the promotion of justice, the Senate will take such action as will promote the ends of justice consistent with the privileges and rights of the Senate: Now, therefore, be it

RESOLVED, That the Chairman and Ranking Minority Member of the Permanent Subcommittee on Investigations, acting jointly, are authorized to provide to the Department of Justice records of the Subcommittee relating to its investigation of the influence of organized crime on the International Longshoremen's Association.
