Pursuant to Section 18 of the Consent Decree, the Monitor is required to file a Quarterly Report describing the actions he has taken toward achieving the objectives and purposes of the Consent Decree. This First Quarterly Report describes the Monitor’s actions from the period August 29, 1999 to November 29, 1999. The Second Quarterly Report describes the Monitor’s actions from December 1, 1999 to February 16, 2000. This Third Quarterly Report describes the Monitor’s Actions from February 17, 2000, to May 15, 2000.
Document Review
and Analysis
During the second quarterly period, voluminous documentary materials were received from Locals 1, 1001, 1006 and the Training Fund, in response to subpoenas issued in the first quarterly period. Review of these documentary materials, as well of documentary materials received from the GEB Attorney, continued throughout the third quarterly period. Moreover, some additional documentary materials were obtained and reviewed during the third quarterly period.
Charges
Considerable time and effort during the third quarterly period was devoted to in the investigation of a particular union member and former official for alleged multiple acts of misconduct. More than a dozen possible witnesses were interviewed, a substantial number of documents were examined, transcripts and other materials from a prior union proceeding were reviewed, and legal research was done. In addition, the target of the investigation himself was recently deposed.
The Monitor has invited the target’s attorney to make a presentation as to why charges should not be brought. If that presentation proves to be unpersuasive, the Monitor anticipates filing disciplinary charges within the next three weeks.
Other Investigative Activities
The Monitor has continued to issue subpoenas and make document requests. The validity of one subpoena currently is being litigated before this Court.
The Monitor has held meetings with FBI agents, investigators with the LIUNA Inspector General, the LIUNA Inspector General himself, the GEB Attorney, the CLDC Trustee, and others to obtain information and to discuss the progress of the various aspects of the investigation.
Interviews continue of persons with possible knowledge of Consent Decree violations.
